On November 30, 2017, Melick & Porter hosted a Massachusetts Defense Lawyers Association presentation on “Addressing Damages Issues in a Catastrophic Injury Case.” Partner Bill Keville, MassDLA’s Trial Practice Chair, joined with Paul McGowan and John Ducey of the forensic accounting firm Matson, Driscoll and Damico to present on the efficient and effective use of investigative tools, discovery, and experts to credibly rebut excessive damages claims. Several real life fact patterns provided a framework for participants to discuss tactics that may be used to successfully persuade juries to recognize a fair limit to a damages award.
